Dr. Fischer-Zernin has been active for many years in the real estate sector. In addition to advice on the acquisition and disposal of all types of real estate assets (large single buildings, real estate portfolios, retail assets (food and non-food), shopping malls, offices, logistics, residential), he also supports his clients in their financing and refinancing issues as well as in their property management. Structuring advice including related corporate law issues is covered as well.
In the energy sector Dr. Fischer-Zernin´s experience includes:
- Development and construction of power plants including related financing issues
- M&A transactions in the sectors of regional and municipal utilities, transmission and distribution system operators
- Construction or acquisition of off shore wind parks as well as the acquisition or disposal of related participations
- Joint venture agreements in the areas of electricity and gas, e.g. in relation to market coupling.
Especially in the area of cross-border activities or in the corporate environment, parties are frequently looking for dispute resolution mechanisms outside of ordinary courts. Reasons include the relatively easy international enforcement of arbitral awards, the higher speed of proceedings, protection of confidentiality or the inclusion of expert knowledge. Dr. Fischer-Zernin is experienced as party appointed counsel and as arbitrator in ad hoc and institutional arbitration proceedings, especially in his areas of speciality and in corporate disputes.
German labour law is characterized by a vast body of legislation and a considerable amount of case law as well as frequently conflicting interests of the parties involved. Carsten Fischer-Zernin has extensive experience in the conduct of negotiations and the enforcement of his clients' interests in and out of court. He advises and represents companies, committees and individuals in all areas of individual and collective labour law.
